Awful indeed but to answer your question murder or manslaughter, you would need to prove intent to kill in order to convict with a murder charge. I think that would be difficult to do.

It would be manslaughter(homicide involontaire) in England in the absence of contrary evidence.
No doubt the police will look at all the circumstances before bringing charges.

If it was completely accidental (I've heard many stories of parents "forgetting" their babies - especially if it's not their usual routine). How is this poor guy going to live with himself? :?

Reminds me of one of our Drs who had 5-6 Children close in age and they used to take them out in a mini bus. They got to a super market one day and after a couple of minutes discovered one was missing. They and the staff searched the store and the surrounding area ,no joy ,the police were called -nothing so in the end the police sent them home as there was nothing more to be done on scene. They arrived home to find missing child sat on the bottom of the stairs where she had been all along
